DOLE 2 acts swiftly on first Kasambahay complaint

TUGUEGARAO CITY, CAGAYAN---“Non-payment of wages since July 2018”, that was the main complaint of the two daughters of a Kasambahay last week at the Department of Labor and Employment – Regional Office No. 2 (DOLE 2).

“Hindi po pinapasahoran ng kanyang amo mula pa noong July 2018.  Ang masama po, kinukulong sya sa third floor at hindi pinapakain nang dalawang araw na po,” said one of the daughters of the Kasambahay.

“Habang kami po ay patungo dito sa DOLE ay tinawagan kami ng aming nanay.  Habang kami po ay nag-uusap bigla po naming narinig ang kanyang amo na sumigaw.  Ang suspetsa po namin ay sinaktan nya ang aming nanay.  Kalaunan, hindi na po namin matawagan ang aming nanay,” added one of the complainants.

Knowing the urgency of the matter, DOLE 2 dispersed a team to coordinate with the Police, City Social Welfare and Development (CSWD) and Barangay Officials for a rescue and/or complaint inspection.

Two policemen and three Representatives of the CSWD joined the DOLE 2 team that went to the house of the Employer subject of the complaint.  After explaining the purpose of the team, the policemen invited the Employer and the Kasambahay to the police station.

At the police station, complaints for physical abuse and illegal detention were filed against the employer, after which the Labor Inspector of DOLE 2 interviewed the Employer and the Kasambahay.  The following violations of RA 10361 otherwise known as Batas Kasambahay were discovered: no employment contract; no pay slips; non-coverage of SSS, Philhealth and Pag-Ibig; non-payment of 13th month pay; no Service Incentive Leave; non-payment of wages since July 2018; and placing the Kasambahay under debt bondage.

The Employer was given 10 days to correct the violations.  If she fails, a mandatory conference will be scheduled.  If the Employer is found to have committed unlawful acts in violation of the Kasambahay Law, a fine ranging from ₱10,000 to ₱40,000 and/or imprisonment may be meted.

In 2013, Batas Kasambahay was enacted to strengthen respect, protection, and promotion of the rights and welfare of domestic workers or kasambahay. (END/RBE)
